More Scum

Another week, another chap kicked to death by feral scum.

This week’s Pondlife Award goes to mark Elliott, 21, Curtis Delima, 19 & Gerry Cusden, 16 who were drunk when they attacked & killed 47-year-old Mark Witherall when he caught them burgling his home in Whitstable, Kent.

Mr Witherall disturbed these pieces of scum & chased them outside where they attacked him, clubbing him to the ground with a spirit level. Laughing, they then kicked & stamped on him as he lay defenceless. His life support machine was switched off five weeks after the attack.

Judge Timothy Pontius told the youths "You turned on that unfortunate man like a pack of hyenas. You attacked him with sustained & merciless ferocity."

Elliott was sentences to 23 years, Delima to 20 years & Cusden got 16 years.

Mr Witherall leaves a 10-year-old daughter & an 8-year-old son.

While contemplating if any sentence could fit the crime, in this case it is pleasing to see a judge handing out more meaningful sentences. What’s the betting on appeals and significant reductions in sentences?

Yes, but I blame the whole thinking of the CJS system. I used to work with lads like this when they were kids, and they go through the whole system till at least 18 and often longer with nothing ever happening to them of any consequence, more or less irrespective of what they do. I would bet my house they have been criminals since they could walk.

I don’t have any sympathy for them ; I do however wonder if there had been a big kick up the backside for them when they were little, that they might have learnt that authority does have some actual power. It might not have stopped them burgling, but it might have made them think twice about kicking the poor bloke to death.

It is stupid to have the first real intervention at this sort of level. I wouldn’t be surprised if this is the first time there has been any *real* sanction applied to them at all (e.g. not cr*p like “community service” (not done) or “cautions” (laughed at).

What really bothers me is not that this happens. It’s that it now appears to be a regular occurrence.

A DC at one of my nicks used to send prolific villains cards for their 18th birthday proclaiming something like, “Congratulations. You are now an adult – and everything that that entails!” Sometimes it used to work, especially among the more intelligent. Unfortunately, after a complaint by a mother of one such recipient (no one knew who, or where, his father was) the DC was ‘advised’ by his DI to stop sending them.
